KNOW YOUR VOTING INFORMATION!

One of the biggest and most important United States and Oklahoma elections is tomorrow, November 2, 2010. For many of you, you have already researched the issues and candidates, know your polling place, and are ready to go. For others, however, knowing what you will be voting on is a daunting task and you may not know where to start. For those of you in the latter category, or for those who simply want a little bit more information, read on for some helpful steps to take before you vote and for some vital links to ballot information.

Steps to Take to Ensure a Smoother Voting Process:

  1. Know Your Information! Before you go vote, make sure you know the following: your voting precinct, state Senate district, state House district, County Commission district. Knowing this information can ensure that you get all the proper ballots and the right candidates to choose from on your ballot. Follow this helpful link to the Oklahoma State Election Board. Simply click on find your polling place and enter your name, birthday, and zip code. Take this information with you when you vote.
  2. Know Your Oklahoma State Questions and Candidates! How are Oklahoma real estate matters resolved in court!

There are different types of cases and courts in which a real estate related matter can be heard. When it comes to real estate, there could be issues related to property lines, ownership, title problems, failure to declare previous issues in a disclosure statement or much more. Here are several types of issues that could arise and how they are generally handled.

In small claims court, the case is usually over things with a value of less than $6000. Many times in small claims court people are unrepresented when it comes to a small dispute over less than $6000 or disputes over a renter and landlord. Cases like these are usually heard by the judge within 30 days and are decided the day of the court hearing. For an eviction, you give notice to a tenant and have it posted. If they don't respond or pay you the debt they owe, you file a petition at the courthouse with appropriate information. It is filed and you pay a small fee and they send a notice out. You are usually given a court date within 30 days. If you are a renter and the landlord's property (where you live) is involved in a foreclosure, there are several things that can happen. What Exactly Is Oklahoma Title Insurance?

Title insurance protects your claim of ownership of your Tulsa, Oklahoma property. When you buy commercial real estate in the Tulsa, OK area, you count on the paperwork being properly reviewed. You should get a "title opinion" from an attorney. That does not, however, provide you any insurance that the attorney did not make an error or that someone later does not come back and claim an error was made (regardless who is right or wrong.) Protect Your Business From Fire!

Oklahoma State Questions on the Upcoming November Ballot

On November 2, 2010 there will be an election in which 11 Oklahoma state questions will be decided. When there are so many questions on a ballot, it can be difficult to remember the details of each question and how we feel about them. Today, we will discuss the first of the eleven Oklahoma state questions- SQ 744.

SQ 744: The measure repeals a Section of the State Constitution. The repealed section required the Legislature annually to spend $42.00 for each common school student.

Common schools offer pre-kindergarten through twelfth grade.

The measure also adds a new Article to the Constitution. It sets a minimum average amount the State must annually spend on common schools. It requires the State to spend annually, no less than the average amount spent on each student by the surrounding states. Those surrounding states are Missouri, Texas, Kansas,
Arkansas, Colorado and New Mexico. When the average amount spent by surrounding states declines, Oklahoma must spend the amount it spent the year before.

The measure deals with money spent on day-to-day operations of the schools and school districts. This includes spending on instruction, support services and non-instruction services. The measure does not deal with money spent to pay debt, on buildings or on other capital needs.

The measure requires that increased spending begin in the first fiscal year after its passage. It requires that the surrounding state average be met in the third fiscal year after passage. The measure does not raise taxes, nor does it provide new funding for the new spending requirements.

Protecting Your Tile Floor from Stains

Did you know that there is an easy way to protect your commercial tile floor from moisture, stains, and mildew? Simply seal your tile grout. After tile is installed and grouted, it is important to seal the grout in order to prevent moisture, stains, and mildew from seeping into the grout. Sealing your grout will also enable you to clean your tile less often since it helps prevent dirt from getting into the grout. Here are the basic steps to seal the grout on your tile floor:

  1. Wait a minimum of 48 hours after your tile is installed before you attempt to seal the grout. Some installers recommend that you wait 2-3 weeks before sealing. This helps ensure that the grout is completely set.
  2. Use a silicone or water based grout sealer and apply with a paintbrush. You can also buy spray on grout sealer for more convenience.
  3. Remove excess sealer from the tile before it has a chance to dry.
  4. Allow the sealer to dry for at least one hour.
  5. Apply another coat using the steps above. (Some installers recommend a second and even third coat of sealer)
  6. To find out if you need a second or even third coat of sealer, test the sealer by dropping a little water on the grout. If the water beads up, no need for another coat. If it doesn't, simply apply more coats of sealer until the water beads up on the grout.
  7. Remember that grout sealer has a potent smell. To avoid the smell, get out of the house for a while until it has a chance to dry and air out. Also, read and follow the directions on the bottle carefully.
  8. Reapply grout sealer as recommended. Commercial tile floors might need sealer applied more often so check the usage directions. If you aren't sure, simply check the sealer as you were instructed in step 6. If the water beads up, apply more sealer.

Preventing Water Damage!

Water damage and leaks can be anything from a minor irritation to a major problem. For some homeowners, the damage caused from water leaks may be covered under their homeowner's insurance policy. For others, the cost to repair these damages is out-of-pocket. No one likes to spends lots of money in repairs, therefore preventing damage is the best way help prevent those excess expenses.
  • Occasionally, check appliances that use water. Check for leaks around hoses, underneath for soft flooring and nearby for evidence of water leaks. When leaving the house, don't leave these appliances running. Disconnect or turn off the water to your washing machine before leaving the house for extended periods of time.
  • Check sinks, showers/tubs, and toilets for clogs and loose caulking. Also check for soft flooring or water nearby that might indicate a leak.
  • Check your water heater for rust and for wet spots on the floor.
  • Make sure your roof is in good condition, all soffits and vents allow for good air flow, there isn't any debris on the roof or guttering, and there is no evidence of bent, missing or damaged shingles.
  • Before and during cold weather keep faucets off and hoses disconnected from the spigots.
  • During warmer weather, have your A/C unit serviced to ensure that it is in good working order.
  • Check all caulking and paint on the exterior of your house and around windows and doors.
  • Prevent water from sitting around the foundation of your home by filling low spots.
  • If you suspect a leak that you can't find, turn off all appliances (that use water), faucets and don't flush the toilet. Record your water meter reading at the beginning and ending of an hour. If the number has changed, a leak is possible.
  • Make sure everyone in the household knows where the water shut-off valve is in case of an emergency. Turning this off while away from home for vacation can also help to prevent damage from leaks.

New Area Code

By  now, probably most everyone in the 918 area has heard that we will be getting a new area code.  It will no longer be simply 918.  Now we will be adding area code 539.  The hardest part for most of us will be getting adjusted to using a 10 digit phone number every time we call.  To ensure that we are all ready for the new area code and 10 digit calling, the Oklahoma Corporation Commission has set up a practice period before the 10 digit calling is required.  Keep these dates in mind:

  • July 7, 2010- You should have received a notice in the mail with dates and information about the new area code.
  • August 7, 2010-  "Permissive Calling Period Begins"-  you can call using 7 or 10 digits.
  • March 5, 2011- "Permissive Calling Period Ends"-  you will now be required to use the 10 digit number.
  • April 1, 2011-  New 539 area codes will be available.  You can also request a 918 area code phone number if one is available.
  • Spring 2012- 918 area code phone numbers are expected to run out.
The same long distance rules will apply for the 539 area code.  Simply put, if you can call a 918 area code now without long distance, you will be able to call 918 or 539 without long distance.  If you pay long distance to call 918, then you will also pay for the 539 area code

Court Appointed Special Advocates give children in the custody of the State a voice in court. Many children who have been removed from their homes are thrust into a system of attorney's, case workers, Foster homes, judges, and a host of other representatives. Quick Tips for Increased Security

Security is important to just about everyone. For commercial properties, however, it can be even more challenging at times. Whether you are an employee or business owner, keep these simple tips in mind to help ensure security for everyone.

  • Always know your surroundings. If you have relocated your business or taken a new job, take a walk or drive around during the day and check out the area. How New Lead-Based Paint Law Affects You!

There is a new lead-based paint law that has been issued by the Environmental Protection Agency. The new law, the Toxic Substance Control Act, requires that companies must be certified by the EPA and workers must also be certified to remove or do activities that might disturb lead-based paint. These activities usually include renovation, repair, and painting done in or near areas that have lead-based paint (properties that were built before 1978). This law comes with heavy penalties as well, up to $37,500 per violation, per day. Not only can the contractor be fined, but Realtors and Brokers can be fined as well. Lead-based paint was used in construction prior to 1978. Lead can cause a multitude of health problems for both children and adults which include:
  • reproductive problems
  • high blood pressure
  • hearing issues (children)
  • nerve disorders

  • brain and nervous system damage (children)
  • hyperactivity and other behavioral and learning problems (children)

Full of Stuff?

Is your office or commercial space full of "stuff". Here are a few quick and easy tips and questions to help you get your business de-cluttered in no time.

  • Sometimes it can be helpful to de-clutter before tackling any cleaning. Once you de-clutter there will be less stuff to clean and less stuff on counters, floors, and tables to move around.
  • When de-cluttering, set out three boxes. One box is for things to keep, one is for things to donate, the last is for things to throw away. Consider these questions when deciding what to do with each item.
Do I need the item?
Will I ever use this item again?
When did I use it last time?
Has it got sentimental value?
If it needs repair, will the repairs be made?
  • Be realistic when de-cluttering. If you are short of space or haven't used it in a while, throw it away or donate it.
  • Don't take a lot of time when de-cluttering. Many times, the longer you spend on one item, the more likely you will convince yourself that you need to keep it. If you still find it difficult to decide, put in aside for later and come back to it.
  • If you find there is something, especially large items, that you need to keep but don't have space for, put it in storage.

Getting Rid of Bad Tenants

As a landlord, what are your rights when you have problems with a bad tenant? A landlord can give notice to a tenant and after a certain notice time, can file a Forcible Entry and Detainer Action at the Tulsa County Courthouse. This can be done for many reasons: not paying rent, too many cars, pet issues and many more problems.

As a landlord, you do not have to have an attorney in order to do this. You can go to the courthouse and fill out the documents yourself. give notice to the parties in the situation, and then get a court date. When this has occurred, if the tenant has not vacated the property you may be able to obtain a Writ of Assistance so that the Sheriff can come out and assist you in removing the persons belonging from the property and enabling you to get in.

Top 5 Tips for Securing an Accurate Appraisal

When it comes to buying or selling property, a successful outcome often hinges upon an accurate appraisal. Unfortunately, due to unrest in the appraisal industry sparked by government guidelines imposed by the Home Valuation Code of Conduct (HVCC), securing an accurate appraisal can be hard to come by these days. Colleagues have shared many a horror story about an appraisal gone wrong and a client that's left to pay the price.

As a member of the Top 5 in Real Estate Network®, however, I have learned that there are steps you can take to help ensure an appraisal accurately reflects the home's value. Consider the following advice:

1. Keep it local. Inaccurate appraisals are often the result of the current practice of using an appraiser who is unfamiliar with your community…sometimes, they're even coming from another state! Talk to your agent and/or lender and insist that the appraiser involved is local and, therefore, understands home values in your neighborhood.

2. Utilize comps.
Make sure your lender and appraiser are accurately leveraging comps (comparable market sales) of local properties sold within the last six months to help appraise your home. Your real estate agent can help in this area.

3. Put your best foot forward. If you are selling your home, make sure it's in the best possible shape before the appraiser visit. Invest in any necessary repairs and effective cosmetic changes. Consider how your home stacks up against other homes in your neighborhood and let that be your guide.

4. Review carefully.
Review the appraisal thoroughly to make sure all the basic facts are correct: square footage, features of the home, number of rooms, etc. If you find mistakes, call the appraiser and ask to have them corrected. If the appraiser refuses to make the corrections, file a complaint with your state's real estate appraisal board.

5. Don't settle.
You are not bound to accept the appraisal results. Both buyers and sellers can request a new appraisal. There is no guarantee that the bank will accept the new appraisal, but it can be used to challenge the first appraisal.

Citizens Share Concerns Over PlaniTulsa

Citizens shared concerns over PlaniTulsa at a recent Tulsa Metropolitan Area Planning Commission Meeting. Although 15 people spoke at the meeting, only one person asked the commission to reject the proposed plan update. Not everyone was completely happy with the plan though. There are different aspects of the plan that citizens dislike. According to the Tulsa World, one woman expressed concern over the "plan's emphasis on pedestrian-friendly mixed use development". Other citizens are waiting to see if plans for their area will actually come to pass since previous plans never did.

Carbon Monoxide Safety

Carbon Monoxide is something that many of us simply don't think about, yet it can be very dangerous. Carbon Monoxide is a gas that can be created when combustible fuel doesn't burn properly or when the exhaust is not properly vented. It can come from appliances, water heaters, exhaust from your car, blocked chimney flues and malfunctioning appliances that burn fuel. FIRE-INSURANCE FOR UNDEVELOPED LANDS?

Is 'Fire-Insurance' for the benefit of undeveloped lands necessary?

 

The answer is yes. It has been my experience that owners and buyers of undeveloped lands in Oklahoma are not advised at all on the issue and when the issue is raised, the advice normally given is 'no'. This is a mistake. As we all know in Oklahoma, grass does burn. Fire, and not just the wind, does come "…sweepin' down the plain…."

 

When grassfires devastated various areas in Oklahoma in 2005 and 2007, the fires were extinguished by the heroic efforts of our area fire-fighters (who in Tulsa deserve a lot better but that is for a future discussion). Numerous Fire Departments were involved with the effort and assisted in areas outside their City's limits or jurisdictions. Since many of the grassfires were on property not within that Fire Department's jurisdiction, the property owners of these lands were sent a bill for their services and I heard of bills being as much as $30,000.00 to $40,000.00. To make it even worse, there were efforts to add the bill as a charge to the property's ad valorem tax bill so that the cost would be a 'lien' against the property and if unpaid the lien would be satisfied from the proceeds of any future tax sale.

 

The impact of this scenario could have been minimized if the property owner had contacted and paid the fire-protection service fee to their nearby municipality. The annual fee by some municipalities is as low as $40.00 per year.

 

For property not within the city's limits of a municipality it is recommended that the nearest municipality be contacted in regards to the availability and cost of such fire protection. It is also recommended for someone who has a home on acreage that their hazard insurance carrier be contacted as well to verify that such risks are covered and the extent of such coverage. Also, any such policy should cover the risk and liability of a fire jumping your fence and setting the neighbor's property on fire.

What Not to Pack!

Packing and moving can be a lengthy and stressful process. Knowing what to pack is simple though, right? Unfortunately, it isn't always so simple! What is Land Use Planning?

Land use planning is a process where experts assess the land and its resources with the goal of making the land most beneficial to the users while also conserving the environment. While this process does take time, it can be very beneficial to property owners and the environment. As land is used up over time, it is very important to conserve the limited resources available to us. Land use planning helps all involved to make the best use of the land and help anticipate future needs and possible changes.

There are many steps and factors that are present when developing a land use plan, from discussions with owners to legal, economic, and social factors. The basic steps in land use planning are as follows:
